Avoid Selling These Amazon Restricted Brands

Several name brands do not like resellers thus it is good practice to avoid selling particular restricted brands. Why? Because those brands may file an Intellectual Property Violation (IP) against your selling account if they see you selling their brand. And too many IP complaints could put your account in jeopardy of being deactivated.

What is an Intellectual Property Violation?

An Intellectual Property Violation is when a brand detects that their products are being sold by someone other than an official retailer. This includes selling items that have been sourced with the intent to resell them, as well as counterfeiting or otherwise violating trademarks and copyrights.

Amazon Restricted Brands That Send IP Violations

While I mainly sell via Amazon FBA, the following such violations apply to most other online marketplaces including Ebay (VeRO reports) and Walmart Marketplace (Prohibited Products Policy).

In simple terms, this means that you’re not allowed to sell the brand’s products, even though Amazon has no official restrictions on brands. If you receive an IP violation, there will be a warning under ‘Performance’ > ‘Account Health’ > ‘Product Policy Compliance’ > ‘Received Intellectual Property’. You’ll also get an email from Amazon with subject line: “Notice: Policy Warning” coming from [email protected]. See example below:

The best way to avoid receiving these dreadful emails to not sell the brands that are known to file IP complaints. One can that wish Amazon would restrict users from even having the choice to add these brands, but alas they do not. Therefore, I have been compiling a list of brands on Amazon that have personally filed an IP complaint against me or other reputable resellers and/or sent out a legal cease and desist letter to me or them.

List of 300+ Restricted Reseller Brands 

Please be aware that if you consult other lists of restricted brands, their lists may be longer but they may contain “gated” brands which is totally different than “restricted” as technically one can become “ungated” to sell those gated brands with no repercussion.

In some cases (as noted in parentheses), the brand may let you sell their product as “Used-Like New” so be sure to list the item’s condition correctly when adding it your inventory to avoid any IP claims.

Avoid Selling These Amazon Restricted Brands

Are there any Amazon Restricted Brands that we’re missing? If you have received an IP violation or cease and desist from a brand not currently on our list, please contact us to add. We may ask for proof that it happened. It’s unfortunate but because not every Amazon seller is fair, we’ve had to put this policy in place. Please also note that other lists may also include brands that they personally sell a lot on their own account in order attempt to keep other sellers from becoming their competition.  

IP Violation Response Email Template

If you do receive an IP infringement notice or warning for infringement and you believe the rights owner or Amazon made an error, you may appeal or dispute the claim, but first I usually 1) delete the item in question, and then 2) respond to the original email (shown above) emailing the contact email address given with this response. You will obviously need to update the information in brackets.

Hello [NAME],

Thank you for bringing this issue to our attention.

All of our inventory for this product was purchased brand new from [STORE], an authorized distributor. We double-checked to make sure the product that we bought matched the description, title, and image on the existing Amazon listing exactly. We then sent the product to a Fulfillment By Amazon (FBA) warehouse. Since this item was purchased from an authorized source, and this inventory can be traced back directly to the manufacturer, this is not an intellectual property rights violation.

We have been selling on Amazon for [LENGTH OF TIME], and we would never want to risk our business by sending in a product that was not authentic, brand new, conforming to all of Amazon’s policies and procedures.

We would appreciate it if you would retract your complaints against us (seller SELLER NAME). In the meantime, we have taken down our Amazon listings per your request. Please let me know if you need any further information to resolve this issue.

Some companies (but not a lot) will respond favorably and retract the claim. Most will get you no response, so then you have the option to appeal or dispute the claim.
 

Conclusion

To protect your business, always make sure to properly research the brands you are interested in selling. This can help you avoid potentially costly Intellectual Property Violations and keep your online business running smoothly.
